⚠️ CRITICAL COMPLIANCE NOTICE

Use of Backbeam Studio for "Robocalling", "Grey Traffic" (VoIP bypass), or unsolicited marketing without consent is strictly prohibited and subject to immediate account termination and legal action under US TCPA, UK PECR, and Pakistan PECA laws.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you ("Customer") and Backbeam Studio Ltd. ("Backbeam"). By accessing the Service, you confirm you are of legal age and have the authority to bind your entity.

2. Regional Compliance Requirements

You agree to adhere strictly to the laws of the jurisdiction in which you operate AND the jurisdiction of the persons you are contacting.

🇺🇸 United States (TCPA & TSR)

  • TCPA Consent: You represent that you have obtained "Prior Express Written Consent" for all marketing calls made using AI systems, as required by the Telephone Consumer Protection Act (47 U.S.C. § 227).
  • DNC Scrubbing: You must scrub all numbers against the National Do Not Call Registry before uploading them.
  • Disclosure: Your AI agent must truthfully disclose its identity and the purpose of the call at the start of the interaction.
  • Class Action Waiver: You agree that any disputes will be resolved by binding arbitration on an individual basis, waiving your right to participate in a class action lawsuit.

🇬🇧 United Kingdom (PECR & GDPR)

  • PECR Compliance: You may not make live marketing calls to numbers registered with the Telephone Preference Service (TPS) unless you have specific prior consent.
  • GDPR Data Rights: You acknowledge you are the Data Controller. You are responsible for fulfilling Data Subject Access Requests (DSARs) from your contacts.
  • Ofcom Rules: You must present a valid Caller ID (CLI) that allows a return call. Spoofing invalid numbers is prohibited.

🇵🇰 Pakistan (PECA & PTA)

  • Prohibition of Grey Traffic: You strictly agree NOT to use the Service for illegal VoIP termination (Grey Traffic) or bypassing LDI gateways. Violation leads to immediate reporting to the Pakistan Telecommunication Authority (PTA).
  • Content Regulation (PECA 2016): You shall not transmit content that is blasphemous, defamatory, anti-state, or violates the Prevention of Electronic Crimes Act 2016.
  • SIM/Caller ID: Using Backbeam to mask origin for fraudulent purposes (CLI Spoofing) is strictly prohibited.

3. Acceptable Use Policy (AUP)

Regardless of location, the following uses are strictly prohibited:

  • Emergency Services: You may not use the AI to call 911, 999, 15, or other emergency lines.
  • Harassment: Any use of the platform to threaten, stalk, or harass individuals.
  • Fraud: Phishing, Vishing (Voice Phishing), or impersonating institutions.
  • High-Velocity Spam: Making excessive calls to the same number after a negative response.

4. Indemnification (Applies Globally)

You agree to defend, indemnify, and hold harmless Backbeam Studio Ltd, its officers, directors, and suppliers from any claims, fines, penalties, or damages arising out of:

  • Your usage of the Service to contact any person without necessary consent.
  • Fines issued by the FCC (US), ICO (UK), or PTA (Pakistan) regarding your traffic.
  • Any breach of the representations made in Section 2.

5. Payment & Credits

Usage is billed in 60-second increments. Rates vary by destination. For Pakistan termination, strictly regulated LDI rates apply to prevent grey traffic usage. We reserve the right to request Know Your Customer (KYC) documentation (Passport/CNIC/Incorporation Certificate) before enabling international dialing to high-risk regions.

6. Liability Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKBEAM'S LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU IN THE LAST 12 MONTHS. WE ARE NOT LIABLE FOR LOSS OF REVENUE, DATA, OR REGULATORY FINES INCURRED BY YOUR CAMPAIGNS.

7. Dispute Resolution & Governing Law

  • Primary Jurisdiction: These Terms are governed by the laws of England & Wales. Examples of grey traffic/telecom abuse may be referred to local authorities in established jurisdictions.
  • Arbitration (US Users): If you are a US resident, you agree to resolve disputes via binding arbitration under AAA rules, waiving jury trials.
  • Severability: If any provision is found unenforceable under local law (e.g., PECA specific clauses), the remaining provisions remain in full effect.
