LEGAL DISCLAIMER: THIS DOC CONSTITUTES A BINDING AGREEMENT REGARDING DATA USAGE. BY USING THE BACKBEAM STUDIO PLATFORM, YOU ACCEPT THESE TERMS.

This Privacy Policy ("Policy") describes how Backbeam Studio Ltd. ("Backbeam", "we", "us", "our") collects, uses, and discloses information, and what choices you have with respect to the information. This Policy applies to the Backbeam AI Voice Platform, websites, and related services (collectively, the "Services").

1. Definitions

  • "Customer" means the entity that creates an account and uses our Services.
  • "End User" means an individual who interacts with the Services (e.g., a person receiving a call from our AI).
  • "Customer Data" means data provided by the Customer for processing, including phone lists, scripts, and API payloads.
  • "Interaction Data" means the audio, transcripts, and metadata generated by the AI agent during a call.

2. The Information We Collect

2.1 Information You Provide

We collect information you provide directly to us:

  • Account Information: Name, email address, company name, billing address, and payment method details (processed by Stripe).
  • Campaign Data: Phone numbers, names, and custom variables (CRM fields) of the End Users you wish to contact.
  • Content: Scripts, voice prompts, knowledge base documents, and system prompts used to configure the AI agent.

2.2 Information Automatically Collected

  • Voice Recordings: By default, we record all audio of interactions to provide the Service and for Customer quality assurance.
  • Transcripts: Real-time text generation of the conversation.
  • Log Data: Internet Protocol (IP) address, browser type, ISP, landing page, exit page, and platform type.

3. Critical: Compliance & Consent (TCPA/GDPR)

YOUR RESPONSIBILITY AS A DATA CONTROLLER

You seek to use the Services to contact End Users. You acknowledge that you are the "Initiator" of these calls. Backbeam is merely the "Provider."

  • Consent: You represent and warrant that you have obtained all necessary consents (including express written consent where required by the TCPA, TSR, or GDPR) to contact the End Users.
  • Recording Laws: You acknowledge that laws regarding the recording of calls vary by jurisdiction (e.g., "Two-Party Consent" states). You agree to configure the Service (e.g., by enabling an automated disclosure) to comply with such laws.
  • Do Not Call (DNC): You are solely responsible for scrubbing your Campaign Data against national, state, and internal Do Not Call registries.

4. Liability Limitation & Indemnification

Read this section carefully.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKBEAM SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM YOUR USE OF THE SERVICES IN VIOLATION OF APPLICABLE LAWS (INCLUDING BUT NOT LIMITED TO TCPA, GDPR, CCPA).

Indemnification: You agree to defend, indemnify, and hold harmless Backbeam, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with: (a) your violation of these Terms or this Policy; (b) your violation of any third-party right, including processing data without consent; or (c) any claim that your use of the AI agent caused damage to a third party.

5. How We Use Information

We use information to:

  • Provide, maintain, and improve the Services.
  • Bill you for the usage of the platform.
  • Prevent fraud and abuse of our systems.
  • Model Improvement (Non-Proprietary): We may use anonymized, aggregated metadata to improve system latency and reliability. We do NOT use your specific Customer Data or Interaction Data to train foundational Large Language Models (LLMs) shared with other customers.

6. Data Sharing & Sub-Processors

We do not sell your data. We share data only with:

  • Telephony Providers: (e.g., Twilio) to connect the call.
  • AI Providers: (e.g., OpenAI, Anthropic) to generate the text response. Note: We engage these providers explicitly via "Zero Data Retention" (ZDR) or enterprise agreements where possible to prevent model training on your data.
  • Voice Providers: (e.g., ElevenLabs) to synthesize the audio.
  • Legal Authorities: If required by law, subpoena, or to protect the safety of any person.

7. International Data Transfers

We operate in the United States. Your information, including Personal Data, may be transferred to—and maintained on—computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there.

8. Security

We use enterprise-grade security measures including AES-256 encryption at rest, TLS 1.3 in transit, and strictly controlled access policies. However, no method of transmission over the Internet is 100% secure. We cannot guarantee absolute security.

9. Children's Privacy

Our Service does not address anyone under the age of 18 ("Children"). We do not knowingly collect personally identifiable information from anyone under the age of 18. If you utilize our AI to contact individuals under 18, you strictly violate our Terms of Service.

10. Changes to This Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. You are advised to review this Privacy Policy periodically for any changes.
